An employee seeking compensation under the Federal Employees' Compensation Act has the burden of establishing the essential elements of his claim by the weight of reliable, probative, and substantial evidence, including that he: 1) is an employee within the meaning of the FECA; 2) filed his claim within the applicable time limitation; 3) was actually injured in the manner claimed; 4) was injured in the performance of duty; and 5) has a disability that is causally related to the employment injury. Examples of Traumatic Injuries include a one-time injury such as a fall or injury lifting a heavy object.


Continuation of Pay:

  • If you have experienced a Traumatic injury, you may be entitled to Continuation of Pay, in which your pay will continue for up to 45 days after your injury occurred. To be eligible for continuation of pay, a person must: 1) have a traumatic injury, which is job-related and is the cause of the disability, and/or the cause of lost time due to the need for medical examination and treatment; 2) file Form CA-1 within 30 days of the date of the injury, and 3) begin losing time from work due to the traumatic injury within 45 days of the injury. calendar days. To establish that an injury was sustained in the performance of duty in a claim for occupational disease, an employee must submit: 1) a factual statement identifying employment factors alleged to have caused or contributed to the presence or occurrence of the disease or condition; 2) medical evidence establishing the presence or existence of the disease or condition for which compensation is claimed; and 3) medical evidence establishing that the diagnosed condition is causally related to the employment factors identified by the employee. Examples of Occupational Diseases include injuries occurring over time such as ongoing physical injuries (i.e., back injuries), psychological/stress, hearing loss, vision loss, cardiac, exposure, etc.


  • A recurrence of disability means an inability to work after an employee has returned to work, caused by a spontaneous change in a medical condition that resulted from a previous injury or illness without an intervening injury or new exposure to the work environment that caused the illness
